Online-Post.ca is a service provided by Davette (Business Number: 79277 2238, BC PST: PST-1498-6273), a sole proprietorship registered in British Columbia, Canada.
1. Acceptance of Terms
By accessing or using Online-Post.ca (the "Service"), operated by Davette ("we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not use our Service. These Terms constitute a legally binding agreement between you and Davette, operating as Online-Post.ca. Please read them carefully before placing an order.
You must be at least 18 years of age or the age of majority in your province or territory of residence to use this Service.
2. Service Description
Online-Post.ca provides an online platform for sending physical letters within Canada. We print, fold, envelope, and mail your letters through external postal providers (such as Canada Post) on your behalf.
We may also provide letter templates designed to assist you with common correspondence needs. These templates are provided "as is" for your convenience. We do not guarantee the accuracy, completeness, or suitability of any template for your specific situation. You are solely responsible for reviewing, customizing, and verifying the content of any template before submission.
When using our templates and services, we send the letter on your behalf. However, we cannot guarantee any specific outcome, as this depends on the recipient's own policies, procedures, and discretion. We are not responsible for any consequences arising from the use of our templates or the recipient's response (or lack thereof) to your letter.
Online-Post.ca is a technical service provider and is not a law firm. The templates provided are for informational purposes only and do not constitute legal advice. Your use of the Service or templates does not create a solicitor-client relationship between you and Davette. We strongly recommend consulting with a legal professional for matters involving legal rights or obligations.
3. Order Submission and Modifications
Once an order is submitted, it is considered final. No changes, modifications, or cancellations can be made after submission. You are responsible for reviewing all information, including letter content and recipient address, before completing your order.
We will send your letter to the address you provide. We are not responsible for any errors in the recipient's name, address, or any other information you supply. Please verify all details carefully before submitting your order.
4. Content Review and Rejection
All letters submitted through our Service may be reviewed by our team before processing. We reserve the right, at our sole discretion, to reject any order that contains content we deem inappropriate, illegal, defamatory, harassing, threatening, or otherwise objectionable.
The criteria for rejection are determined solely by Online-Post.ca and will not be disclosed. If your order is rejected, a refund will be issued for that order.
5. User Responsibilities
By using our Service, you agree to:
- Provide accurate and complete sender and recipient information
- Not use our Service for any illegal, fraudulent, harassing, defamatory, or threatening purposes
- Not send content that violates any applicable federal, provincial, or local laws or regulations
- Not impersonate any person or entity or misrepresent your affiliation with any person or entity
- Pay all applicable fees for the services you order in Canadian dollars
- Review and verify all letter content and recipient information before submitting an order
- Acknowledge that your letter content may be reviewed by our team members and refrain from including any images, text, or sensitive information that you do not wish to be seen or read by third parties
- You warrant that the content of your mail complies with the Canada Post Corporation Act and the Non-mailable Matter Regulations. You agree not to use the service to send 'Non-mailable matter,' which includes but is not limited to anything that is obscene, consists of sexually explicit material, or is related to fraudulent schemes
- Acknowledge that for registered or tracked services, proof of mailing or delivery is provided by the external postal provider (e.g., Canada Post) and is subject to their records and policies, not our own internal records of delivery.
6. Delivery Times and Limitations
All delivery timeframes referenced on our website are estimates only, expressed in business days (Monday to Friday, excluding statutory holidays), and are not guaranteed. Delivery times do not include processing time and may vary depending on the destination.
Actual delivery depends on external postal providers (such as Canada Post) and factors beyond our control. We are not responsible for any delays in the delivery of your letter, regardless of the cause, including but not limited to postal service delays, weather conditions, labour disruptions, or incorrect addresses provided by you.
7. Payment Terms
All payments are processed securely through Stripe, a third-party payment processor. Your credit card or payment information is transmitted directly to Stripe and is not stored on our servers. By making a payment, you agree to Stripe's terms of service and privacy policy.
All prices are displayed in Canadian dollars and do not include applicable taxes. Taxes will be calculated and added during checkout based on the postal code you provide. We reserve the right to change our pricing at any time without prior notice.
8. Refund Policy
No refunds will be issued once an order has been submitted, except in the following circumstances:
- Your order is rejected by our team during the content review process
- A technical error on our part prevents your letter from being processed
We do not issue refunds for delivery delays, undeliverable mail due to incorrect addresses provided by you, or any outcomes resulting from the recipient's response to your letter.
9. Privacy and Data Protection
Your privacy is important to us. Your documents and personal data will be processed by Online-Post.ca solely for the purpose of fulfilling your letter mailing request. We collect and use your information in accordance with applicable Canadian privacy laws, including the Personal Information Protection and Electronic Documents Act (PIPEDA) and the British Columbia Personal Information Protection Act (PIPA).
The content of your letter will be automatically and permanently deleted from our systems 30 days after your order is submitted. We retain only the minimum information necessary for legal, accounting, and customer service purposes.

10. Intellectual Property
Online-Post.ca, its logo, and all associated branding are trademarks of Davette. All content on our website, including templates, graphics, and text, is protected by copyright and other intellectual property laws.
You retain ownership of any original content you submit for mailing. By using our Service, you grant us a limited, non-exclusive license to print, process, and mail your content solely for the purpose of fulfilling your order.
11. Limitation of Liability
To the maximum extent permitted by applicable law, Davette (operating as Online-Post.ca), its owner, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to your use of the Service, including but not limited to:
- Errors in addresses or letter content provided by you
- Delays in delivery by postal services
- Lost, stolen, or undelivered mail
- Any actions taken or not taken by the recipient of your letter
- Any consequences arising from the use of our templates
- Any errors or inaccuracies in template content
In no event shall our total liability to you exceed the amount you paid for the specific order giving rise to the claim.
You acknowledge that once a letter is handed to Canada Post or another carrier, it is out of our physical control. We are not responsible for the 'security of the mail' once it has been inducted into the postal system.
12. Indemnification
You agree to indemnify, defend, and hold harmless Davette (operating as Online-Post.ca), its owner, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from or related to your use of the Service, your violation of these Terms, or your violation of any rights of a third party.
13. Appointment of Agent
By submitting an order, you appoint Davette (Online-Post.ca) as your agent for the sole purpose of printing, packaging, and tendering your correspondence to Canada Post or other designated carriers. You remain the legal "sender" of the mail for all regulatory and legal purposes.
14. Disclaimer of Warranties
The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee any specific delivery times or outcomes resulting from the use of our Service or templates.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any dispute arising from or relating to these Terms or the Service shall be resolved exclusively in the courts of British Columbia, and you hereby consent to the personal jurisdiction of such courts.
16. Changes to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting the updated Terms on our website with a new "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
We encourage you to review these Terms periodically for any updates.
17. Severability
If any provision of these Terms is found to be invalid, unenforceable, or illegal by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving its original intent.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Davette (operating as Online-Post.ca) regarding your use of the Service and supersede all prior or contemporaneous agreements, communications, and proposals, whether oral or written.
